1. Parties

These Terms of Service ("Terms") are a binding agreement between you ("Customer", "you") and Vive Tennis Inc., a Canadian corporation with offices at Unit 6, 3429 Yonge St, Toronto, ON M4N 2N1 ("Vive Tennis", "we", "us"). By visiting vivetennis.ca or ordering a Vive Tennis product, you agree to these Terms.

2. Product description

The Vive Tennis robot is a consumer hardware product that uses computer vision and on-device AI to autonomously locate and collect tennis balls on a court. Specifications are described on our home page and may evolve with product updates. We reserve the right to improve specifications without prior notice; material changes to functionality will be communicated to customers in advance.

3. Orders, pricing and payment

• The current price of the Vive Tennis robot is CAD $599, exclusive of applicable taxes and shipping. Prices are subject to change; the price displayed at the time you submit your order is the price that applies to your order.
• All prices are in Canadian dollars (CAD) unless otherwise stated.
• Orders are confirmed by email after we receive your payment. Until confirmed, an order may be cancelled by either party.
• Applicable taxes (GST/HST/PST) are added at checkout based on your shipping address.

4. Shipping & delivery

Shipping terms, lead times and costs are described in our Shipping & Returns Policy. Vive Tennis is not liable for delays caused by shipping carriers, customs authorities or events outside our reasonable control.

5. Warranty

Each Vive Tennis robot is covered by a 12-month limited warranty from the date of delivery, covering defects in materials and workmanship under normal recreational use. The warranty does not cover:

• Damage caused by misuse, accidents, modification or unauthorized repair.
• Cosmetic wear from normal use.
• Damage from use in conditions outside the documented operating environment (e.g. heavy rain, extreme temperatures).

7. Intellectual property

All content on vivetennis.ca — including text, photography, video, the Vive Tennis logo and brand marks, and the underlying robot designs, firmware and computer-vision models — is owned by Vive Tennis Inc. or licensed to us, and is protected by Canadian and international copyright, trademark and patent law. You may not reproduce, modify or distribute our content without our prior written consent. Patents on the capture mechanism and perception system are filed or pending.

8. Acceptable use

You agree to use the Vive Tennis robot and website lawfully and not to attempt to reverse-engineer, decompile or extract source code from the firmware, except where such restrictions are expressly prohibited by applicable law.

9. Limitation of liability

To the maximum extent permitted by law, Vive Tennis's total liability arising out of or relating to these Terms or any order shall not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental or consequential damages, including loss of profits, data or use.

Nothing in these Terms excludes or limits liability that cannot be excluded by Canadian consumer-protection law.

10. Indemnity

You agree to indemnify and hold Vive Tennis harmless from any third-party claims arising from your misuse of the product or violation of these Terms.

11. Governing law & jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Ontario have exclusive jurisdiction over any dispute, except where mandatory consumer-protection law provides otherwise.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be communicated to existing customers by email at least 30 days before they take effect.
